They did actually. Interplay lost their case in early 2012. However last October Zenimax announced it was opening up a new design studio in Austin Texas called Battlecry Studios. The studio is being led by Rich Vogel, whos work includes Ultima Online, SWG, & most recently SWTOR.
Based on the talent they're recruiting most folks believe that they are building a team for a new MMO and given the fact that ESO is already well on it's way to Launch most people are speculating that this could be the birthplace of the New Fallout MMO.

Oh, I thought I read somewhere it was Obsidian v. Bethesda, and Obsidian's case was something like they used to be Black Isle which did Fallout 1 and 2, or something...

Obsidian staffers did do Fallout 1/2 back when most of their staffers worked for Black Isle, but Black Isle was a wholly owned subsidiary of Interplay. Interplay owned all of the rights to Fallout, until they sold them to Bethesda.
Interplay retained the right to make a Fallout MMO, but certain progress had to be made by a certain date. Which lead to 1 lawsuit. There was another lawsuit between Bethesda and Interplay because Interplay started selling a box of Fallout 1, 2 and Tactics a few years ago, and via Steam, GoG, etc. Interplay had sold all rights to Fallout at that point, so those boxes come from Bethesda now.
Bethesda would never have contracted Obsidian to make Fallout: New Vegas if Obsidian had fought with Bethesda over the rights to the franchise.
